Service of Process
Please be advised - If the Secretary of State accepts service of process pursuant to the Nevada Revised Statutes, Nevada Administrative Code or the Nevada Rules of Civil Procedure, neither the Secretary of State nor their staff makes a determination or any representation that the service is proper. Such determination is left to a court of competent jurisdiction.
Subpoenas
The Nevada Secretary of State may accept subpoenas requesting corporate records, on behalf of corporate entities and subpoenas requesting the presence of the Secretary of State or any deputy acting in her working capacity with this office. No fee is associated with the receipt of this request.
Consent
Pursuant to certain statutes, the Nevada Secretary of State may be designated as agent for service of process through an appointment of consent. An appointment should be submitted in duplicate to Secretary of State and may be rejected if it:
- Does not contain authorization and a forwarding address.
- Is not acknowledged before a Notary Public.
- Does not set forth a specific statutory citation.
- Is not accompanied by a $10.00 filing fee.
Service of Process
The Nevada Secretary of State may accept service of process in person or by process server at the counter at the Carson City Paul Laxalt Building, and the Las Vegas Office. Delivery by the U.S. Postal or other mail delivery service is to be directed to the Carson City office. Although it is not required, it is highly recommended that service be delivered to this office in a track-able manner.
The Nevada Secretary of State may accept Service of Process for certain entities provided specific requirements are met.
Initial Service:
Please submit service documents with any required copies, payment and a cover letter specifying the filing authority(ies) for service and the exact name of the entity being served.
The person serving at the counter will be issued a receipt identifying the date received, entity being served, fee payment and case number, if available. The person or firm identified as submitting the paperwork via mail delivery service will be sent receipt by regular mail. No stamped document or affidavit of service is issued by this office.
Service Guidelines:
Notice: The filing authority and name of entity being served must be set forth in writing for each service. Filings submitted pursuant to NRS 92A.190, NRS 92A.195, NRS 119.130, NRS 599B.210 and NRS 662.245 must include a duplicate set of documents.

Fee Note: NRS 86.561 Section 2 sets the fee for service of process on an LLC as $100.00.
Certificates Required by NRS 14.030:
Service of Process pursuant to NRS 14.030 specifies a certificate of fact issued by the Secretary of State. Each certificate issued by the Secretary of State requires a $50.00 fee and may be obtained by ordering the required certificate through our Copies or Customer Service Divisions.
- A Certificate of RA Vacancy may be obtained for an entity that does not have a Registered Agent on file with the Secretary of State.
- A Certificate of Non-Existence may be obtained for an entity that has never filed organizational documents with the Secretary of State.
Subsequent Service:
Additional or subsequent documents filed on a particular service established with this office are currently accepted at no additional fee. The documents being served must be accompanied by a cover letter stating the name of the entity being served, case number, that the documents being served are a subsequent filing and include any required copies. Please note that additional filings for service established under NRS 92A.190, NRS 92A.195, NRS 119.130, NRS 599B.210 and NRS 662.245 must be submitted in duplicate.
Refusal of Service:
Service not following the above listed guidelines may be refused at the counter or returned after submission and a rejection letter generated and delivered by certified mail or equivalent delivery service. Please note that service will be rejected if it does not contain duplicate copies when required.
Acceptance of Service:
Please note that the Nevada Secretary of State is a filing agency. Although staff is available to answer questions concerning serving process with this office, they cannot give legal advice. Sufficiency of the service and any other legal questions should be directed to a private attorney. The office makes no representation that receipt or other acceptance of service of process by this office constitutes valid service of process.
