Duties and Notarial Wording

A State of Nevada Notary Public is authorized to:

• Take acknowledgments and proofs;
• Administer oaths and affirmations;
• Execute jurats or verifications on oath or affirmation;
• Certify copies;
• May also perform marriage ceremonies - may be subject to additional requirements determined by the county of residence or employment

• A Nevada Electronic Notary Public who is registered to use audio-video communication may perform the notarial duties set forth in NRS 240.196 for a remotely located individual, subject to requirements and limitations in statutes

Take Acknowledgments and Proofs:

The document signer must present the document to the notarial officer, and acknowledge or declare (state) that he or she previously signed the document, or they can sign the document in the presence of the notary.

If the document is signed in a representative capacity -- for example, the person is an officer of a corporation -- the person must declare (state) that he or she signed the document with proper authority and executed it as the act of the person or entity represented.


The following format and wording is sufficient for an acknowledgment in an individual capacity:

The following format and wording is sufficient for a Translator's Acknowledgment:

 Administer Oaths or Affirmations:

The individual taking the oath or affirmation raises one's right hand while in the presence of the notarial officer. The notarial officer declares the words of the oath or affirmation. The oath taker then repeats these words back and then the notarial officer can complete the notarial wording as required.

 

The following format and wording are sufficient for a verification upon oath or affirmation:

Execute a Jurat:

The jurat is the part of a document, such as an affidavit or verification, in which the notarial officer states that it was sworn to (or affirmed) before them. The notary must first administer an oath by swearing in the document signer.

An oath for a jurat requires that the notary asks, "Do you swear that the statements in this document are true so help you God?" or "Do you affirm that the statements in this document are true".   The document signer would be required to verbally answer or communicate, an affirmative response ("Yes").  The person then signs the document in the presence of the notary and the notary public completes the notarial wording for a jurat.

 Certify Copies:

A notarial officer may photocopy most documents if it is presented to you.  The following language is then attached or stamped, if you have such a stamp, to each copy.

Documents that cannot be notarized as a certified copy:

  • Copies of vital records
  • Copies of publicly recorded documents
  • Documents that indicate copying is illegal
  • Prohibited documents typically include items like birth certificates, death certificates, marriage certificates, divorce decrees, identification cards or any document that is publicly recordable by a state or federal agency.
    • These documents must be obtained from the county where they were originally recorded and cannot be certified by a notary.
