Task Force on Safe Sidewalk Vending  

Senate Bill 92, otherwise known as the Street Vendor Bill, builds a framework for local governments to help street vendors legitimize their businesses and obtain licensure. The bill also creates The Task Force on Safe Sidewalk Vending within the Secretary of State’s Office to help identify challenges and remove unnecessary barriers for street vendors. The Task Force is made up of nine members, including representatives from the health district, a county or city, the gaming or restaurant industry, law enforcement, street vendors and community organizations that represent and advocate for them. 

Task Force Composition  

The Task Force on Safe Sidewalk Vending consists of a representative of a health district in a county whose population is 100,000 or more; a representative employed by a county or city whose primary  duties  are  the  performance  of  tasks  related  to  business licensing; a representative  of  the  gaming  or restaurant  industries  in this State; a representative from a law enforcement agency in a county whose population is 100,000 or more; a representative from the Office of the Secretary of State; and four members at large chosen by the Secretary  of  State, with  priority given to persons who  are  sidewalk vendors or are affiliated with a community organization that represents and affiliates with sidewalk vendors. 

Each member of the Task Force serves at the pleasure of the Secretary of State for a term of 3 years. If a vacancy occurs, the Secretary of State appoints a new member to fill the vacancy for the remainder of the unexpired term. Members of the Task Force serve without compensation.

Duties of the Task Force  

As a member appointed to the Task Force, you are making a commitment to public service and must complete an Oath of Office and the Acknowledgement of Statutory Ethical Standards. Members of the Task Force serve without compensation. The Task Force shall be convened to meet by the Office of the Secretary of State as needed to discuss topics within the scope of its duties, which include:   

  • Review the existing laws of this State, the cities and counties in the State and those of other states and municipalities relating to sidewalk vending. 

  • Recommend approaches to improve the laws of this State and the cities and counties of the State to:

  • Legalize sidewalk vending; 

  • Simplify and standardize the laws governing sidewalk vending;  

  • Remove unnecessary barriers to sidewalk vending;  

  • Protect the public health, safety and welfare by ensuring sidewalk vendors follow clear and narrowly tailored laws, which address demonstrable health, safety and welfare risks; and  

  • Develop enforcement mechanisms, including, without limitation, civil penalties for sidewalk vendors that operate in authorized areas.
