What is the difference between a Service Mark, Trademark and Trade Name?
All definitions are established under the Nevada Revised Statute chapters 600.240-320.
What is the duration of a "Mark"?
The duration of a Mark registration is five years. A Mark may be renewed for another five years by filing a Mark renewal form within six months of the expiration date.
What is a specimen?
A specimen is a sample or photograph showing the exact representation of the Mark as actually used. Specimens commonly provided include letterhead, advertising, brochures, and other items that show the Mark as actually used. Reference NRS 600.343 for full criteria of Specimen.
What is a Design?
A Design is a depiction of the mark, also known as a drawing. A drawing can show your trademark in either standard characters or special form. Standard character drawings are text only with no stylization, color, or design. Special form drawings are stylized, include color, or have a design.
Are a design and a specimen the same?
No, a design shows what the mark is. A specimen shows how you’re using your mark with your goods or services. Additional to the design, the registration must be accompanied by a specimen (NRS 600.343).
What is the date of first use?
Date of first use means the Mark must be in use before submitting the Mark registration form. The date must include month, day and year. The date must be a date prior to the notary date on the application.
What is Mode or manner use?
Mode or manner use is how the applicant is using the mark in connection with the goods or services. For services, an applicant may use the mark on business cards, flyers, brochures, newspaper advertisements, signs, menus, or other forms of advertisement. For goods, an applicant may attach a tag or label directly to the goods or containers of the goods or imprint the mark directly on the goods.
Does my national Trademark preclude me from filing in the state of Nevada?
Generally, if a Mark registration is needed in Nevada, it must be filed with our office. A Mark registration filed with our office is good only for the state of Nevada.
Can I renew my Mark online?
Yes, you may submit any mark filings via SilverFlume.
Can I register for more than one Mark on an application?
No, only one Mark may be registered per application. A separate application for each class for which the mark is used should be submitted.
Can I list more than one classification number on the application?
No, only one classification number is allowed per application.
What if the applicant address has changed within the 5-year registration period?
An amendment/correction form is required to change the address of the applicant.
Which form do I use if I sell or transfer the Mark to another party?
An Assignment of Mark form is used to record the sale, transfer, or assignment.
Can I search for a trademark, trade name or service mark online?

How can I request copies or Certificates of mark filings?
You may request copies of filed documents and Certificates via SilverFlume on the right side of the home page under the Other Business Services, Trademarks/ServiceMarks.
Does a Mark registration replace a DBA (Doing Business As) or a Fictitious name registrations?
No, Doing Business As or Fictitious names are registered at county level.
