Any natural person who falls under the definition of an athlete's agent (NRS 398.408). In general any person who enters into a contract with a student athlete or recruits or solicits a student athlete to enter into such a contract. The term does not include a spouse, parent, sibling, grandparent or guardian of the student athlete acting solely on behalf of a professional sports team or sports organization.

A student athlete is any person who engages in, is eligible to engage in or may be eligible in the future to engage in any intercollegiate sport. There are no age limitations.

Intercollegiate sport includes any sport played at the collegiate level for which the requirements of eligibility for participation by the student athlete are established by a national association for the promotion or regulation of collegiate athletics.

An athlete's agent must hold a certificate of registration issued by the Secretary of State of Nevada. To receive a certificate of registration the applicant must submit an application along with the fee of $500 to the Secretary of State, Securities Division.

The agent may submit an application and current certificate of registration or licensure from another state along with the fee to the Secretary of State, Securities Division IF the other state's application contains substantially similar to or more comprehensive information than that required in the Nevada prescribed application.

The registration expires two years from the date of effective registration. The agent must submit a renewal application prior to the expiration of the registration along with the fee of $500 to the Secretary of State, Securities Division.

The agent must also retain certain records required under NRS 398.480 for 5 years. The records are open to inspection by the Secretary of State, Securities Division.
