Secretary Cegavske Announces Ballot Question Numbers for 2020 General Election

(Carson City, NV; April 16, 2020) – Nevada Secretary of State Barbara Cegavske today announces the ballot question numbers for the constitutional amendments proposed by the Nevada Legislature.  These proposed constitutional amendments will appear on the 2020 general election ballot.

Pursuant to Article 16, Section 1 of the Nevada Constitution, a proposed constitutional amendment that is approved during two consecutive regular legislative sessions must be presented for a vote of the people.  If a majority of voters approve, the amendment will become part of the Nevada Constitution.

The 2019 Legislature advanced four measures that meet the requirements to appear on the 2020 general election ballot.  The four measures are listed below next to the question number that will be assigned to the measure.

  • Question 1Assembly Joint Resolution 5 – Proposes to amend the Nevada Constitution to remove the constitutional provisions governing the election and duties of the Board of Regents of the State University and to authorize the Legislature to provide by statute for the governance, control and management of the State University and for the reasonable protection of individual academic freedom.

  • Question 2Assembly Joint Resolution 2 – Proposes to amend the Nevada Constitution to require the recognition of all marriages regardless of gender.

  • Question 3Senate Joint Resolution 1 – Proposes to amend the Nevada Constitution to expressly provide for the State Board of Pardons Commissioners and revise the duties of the State Board of Pardons Commissioners.

  • Question 4Senate Joint Resolution 3 – Proposes to amend the Nevada Constitution to provide certain rights to voters.

In addition to Questions 1 through 4, Question 6 from the 2018 general election will also appear on the 2020 general election ballot.  Question 6, also known as the Renewable Energy Promotion Initiative, will retain the same number.  Proposed constitutional amendments that originate through the initiative petition process, such as the Renewable Energy Promotion Initiative, must be approved by a majority of voters at two consecutive general elections before becoming part of the Nevada Constitution.

Currently, there are two initiative petitions that seek to amend the Nevada Constitution on file with the Secretary of State’s office (C-01-2019 and C-02-2019).  Supporters of these petitions have until June 24, 2020 to collect 97,598 valid signatures and submit them to the appropriate county election official.  Any constitutional initiative petition with enough valid signatures will appear as a ballot question on the 2020 general election ballot.  Constitutional initiative petitions that gain ballot access will be assigned a ballot question number after certification by the Secretary of State that enough valid signatures were obtained.
